REQUEST FOR QUALIFICATIONS TO PROVIDE MUNICIPAL AGGREGATION ADMINISTRATIVE SERVICES

The City of Boston (the “City”), acting by and through its Commissioner of the Environment (the “Official”), hereby requests qualifications statements from businesses, persons, or entities licensed be a retail electric supplier by the Massachusetts Department of Public Utilities (“Respondents”) to provide municipal electric aggregation administrative services in a manner consistent with the City’s municipal aggregation plan (the “RFQ”). An electronic copy of the City’s RFQ may be obtained after 12 o’clock noon Eastern Time (ET) on April 20, 2020 at the City’s Supplier Portal (boston.gov/supplierportal) under Event ID EV00007935. The RFQ will be available up to the deadline for the submission of qualifications statements as set forth below. This RFQ is exempt from the public bidding requirements of M.G.L. c.30B pursuant to sec. (1)(b)(32) thereof.

Respondents shall submit their qualifications statements electronically via the City’s Supplier Portal no later than 12 o’clock noon ET on May 14, 2020. Qualifications statement must be submitted in a form that conforms in all respects with the requirements specified in the RFQ. A Selection Committee will determine which qualifications statements meet the minimum evaluation criteria set forth in the RFQ, and will rank the qualifications statements based on the criteria stated in the RFQ . 

The City will request a pricing proposal from the Respondent whose qualifications statement has been deemed the most advantageous by the Selection Committee. The City will consider fees structured on a per-account or per-kilowatt hour basis, or a fixed basis. Such fees shall remain in effect, without escalation, during the initial term of the Contract. Should the City and the Respondent whose qualifications statement has been deemed the most advantageous be unable come to a mutually satisfactory agreement on pricing, the City will negotiate pricing with the Respondent whose qualifications statement has been deemed the next most advantageous. The City will continue negotiating with Respondents in the order in which their qualifications statements have been ranked until a contract is successfully negotiated.

Should the City execute a contract pursuant to the RFQ, the contract shall have an initial term of four years and shall include two options to renew and extend the term of the contract for two additional three-year periods, which options shall be exercised at the City’s sole discretion. Should the City exercise its option to renew and extend the contract term the City and the Respondent shall negotiate pricing for each such renewal term.

The Official shall cancel the contract if funds are not appropriated in any fiscal year.

The award of any contract, and the exercise of any option to renew and extend the contract, shall be subject to the approval of the City’s Corporation Counsel and the Mayor of Boston.

The City and the Official reserve the right to waive any defects, or informalities, to accept or reject any or all qualifications statements, or any part or parts thereof, if the City deems it to be in the best interests of the City so to do.
